Ditopile may walk home today

The High Court of Tanzania in Dar es Salaam is to-day expected to resolve the issue of bail for former Tabora Regional Commissioner, Ukiwaona Ditopile Mzuzuri, who is charged with manslaughter.

 

The matter, supposed to have been determined yesterday, was adjourned until to-day at 11:00 am because of what was described as inevitable circumstances.

 

Moments before the court session began, many people converged at the court premises to hear what would happen to the former Tabora regional commissioner.

 

Adjourning the case yesterday, High Court Judge Augustino Mwaringa cited communication problems that ensued among prison officers, police and the court as the basic factor that led to a change of schedule.

 

The accused was not brought to court in the morning.

 

By the time he appeared at 2:15 pm, the judge had already issued an adjournment order to the effect that the matter be heard to-day.

 

Ditopile was taken back to remand prison where he has been living since he was arraigned allegedly for killing without malicious forethought Hassan Mbonde, a daladala driver.

 

It was claimed that the accused committed the offence at Bagamoyo and Kawe Roads junctions within Kinondoni District in Dar es Salaam on November 4, 2006.

 

The bail consideration comes in the wake of a lesser offence for which he is being tried.

 

Initially, the accused was charged with murder. However, the prosecution later altered the charge and substituted it with manslaughter, meaning killing without malicious forethought.

 

Earlier, committal proceedings were conducted by Kisutu Resident Magistrate’s Court where he was not asked to enter any plea.

 

The Resident Magistrate`s Court has no jurisdiction to try and determine the case under existing laws.
